NEW BRUNSWICK, NJ—On May 22, Porfirio Nunez-Mosquea, a resident of North Brunswick, was convicted of kidnapping a 20-year-old woman at gunpoint and molesting her on March 30, 2012.
The 27-year-old’s sentencing is scheduled for September 8 at the Middlesex County Courthouse in New Brunswick. He could face up to 40 years in a state prison.
Nunez-Mosquea has been found guilty of of kidnapping, attempted aggravated sexual assault, criminal sexual contact, unlawful possession of a weapon, possession of a weapon for an unlawful purpose and terroristic threats.
During the trial, which began on April 28, evidence and testimony revealed that the perpetrator grabbed the victim, who was walking on Rutgers Street, near Livingston Avenue in New Brunswick, and forced her into a van at gunpoint.
According to prosecutors, Nunez- Mosquea took the woman to his basement apartment on Jersey Avenue in North Brunswick, attempted an aggravated sexual assault, smothered her when she resisted, and molested her before allowing her to leave.
After a four-day jury deliberation period,the defendant was found guilty on the six counts. The panel did acquit him of attempted murder, and of receiving stolen property in regards to the gun he used to force the woman into the van.
According to the prosecutor’s office, the jury was unable to reach a verdict on a count of aggravated assault for smothering the woman.
Nunez- Mosquea did however plead guilty to a charge of being a certain person prohibited from possession of a firearm. He was on prohibited status because of a previous conviction from an unreleased case.
The evidence presented came from the investigation conducted by Investigator Tracy Lackey of the Middlesex County Prosecutor’s Office and Detective Thierry Lemmerling of the NBPD.
